Section 106 Compliance Projects

Section 106 of the National Historic Preservation Act of 1966, as amended, requires federal agencies to minimize the impact of their undertakings on resources that are listed in the National Register or that are eligible for register listing. An undertaking can include direct funding as well as more indirect involvement, such as permitting or licensing. The scope of Section 106 projects varies widely, reflecting the unique circumstances of each undertaking. Rather than a specific set of actions, Section 106 is a process that requires building consensus among the participating agencies and consulting parties to achieve a satisfactory resolution while minimizing the effects of the project on historic resources. If adverse effects to historic resources cannot be avoided the involved parties must consult with the President’s Advisory Council on Historic Preservation and negotiate a Memorandum of Agreement (MOA) that describes the steps each participant has taken and will take in the future. MOAs commonly require that a qualified preservation consultant identify (survey) historic resources in the project area and evaluate their National Register eligibility. If adverse effects to historic resources cannot be avoided, documentation is a common mitigation strategy. Section 106 also requires the consideration of public input, usually through one or more hearings or meetings.

The role of Rosin Preservation staff in Section 106 projects has been as varied as the projects themselves. In addition to identifying, evaluating, and documenting impacted resources, we have negotiated MOAs and facilitated public meetings, enabling our clients to move their projects forward in a timely manner. Through continuing education we keep abreast of regulatory changes to Section 106.



  • 811 Grand Boulevard. Kansas City, Missouri.
    Coordinated project review with the State Historic Preservation Office and the by U.S. General Services Administration, developed a Determination of Eligibility (DOE) report and an adaptive reuse plan to be used in conjunction with the federal and state rehabilitation tax credits.

  • 1511-15 East 18th Street Redevelopment. Kansas City, Missouri.
    Coordinated project review and compliance with existing Memorandum of Agreement working with State Historic Preservation Office and City of Kansas City, Missouri. Worked with project design team to develop an appropriate approach for demolishing failed portions of building and erecting a new structure, while retaining and restoring the primary façade. Presented project to Landmarks Commission, and submitted documentation for review by State Historic Preservation Office.

  • 18th and Vine Jazz District Redevelopment Project. Kansas City, Missouri.
    Provided guidance to the design team to ensure that the rehabilitation of historic buildings and new construction complied with the Secretary of the Interior’s Standards for Rehabilitation; assisted in the preparation of the Memorandum of Agreement; and coordinated all activities and required reviews with the State Historic Preservation Office.

  • Beacon Hill Redevelopment Project. Kansas City, Missouri.
    Coordinated the Section 106 review process for City of Kansas City, Missouri, which included developing the Memorandum of Agreement; designing and conducting the mandated public participation process for the Christian/Robinson Hospital rehabilitation project.

  • DeLaSalle Education Center. Kansas City, Missouri.
    Facilitated design review of an addition to a private school, coordinating with State Historic Preservation Office, US Department of Housing and Urban Development and City of Kansas City, Missouri.

  • Frost Road Bridge Replacement Project. Kansas City, Missouri.
    Prepared Memorandum of Agreement and bridge documentation report.

  • Highland Place Senior Living Complex. Kansas City, Missouri.
    Coordinated Section 106 review with State Historic Preservation Office; prepared Section 106 Project Information Form and supporting documentation.

  • Kansas City Roundhouse Redevelopment Project. Kansas City, Missouri.
    Assisted developer in the review process with the City and State historic preservation agencies; coordinated the 106 review process with the State and federal rehabilitation tax credit review; assisted the architect with the design of new construction and in negotiations regarding rehabilitation to ensure compliance for Section 106 and rehabilitation tax credit guidelines.

  • Missouri Bank Brookside Branch. Kansas City, Missouri.
    Prepared Section 106 documents necessary for regulatory approval of new bank branch. As part of mitigation strategy, drafted Memorandum of Agreement and prepared report documenting history and appearance of building. Coordinated all work with State Historic Preservation Office, Federal Deposit Insurance Corporation, Missouri Bank, and building owner.

  • Palestine Commons Enhanced Senior Living Facility. Kansas City, Missouri.
    Coordinated Section 106 review with State Historic Preservation Office; prepared Section 106 Project Information Form and supporting documentation.

  • Paradise Playhouse. Excelsior Springs, Missouri.
    Initiated and coordinated review of the project with the State Historic Preservation Office and prepared the Memorandum of Agreement.

  • President Hotel Redevelopment. Kansas City, Missouri.
    Initiated and coordinated project review with the State Historic Preservation Office; developed and facilitated the public participation process; and prepared the Memorandum of Agreement.

  • Riverfront Heritage Trail, Segment 4-F. Kansas City, Missouri.
    Coordinated the Section 106 review with the State Historic Preservation Office; completed the required survey and the National Register eligibility assessment.

  • Sni-A-Bar Road Bridge Replacement Project. Kansas City, Missouri.
    Prepared Memorandum of Agreement and bridge documentation report.

  • Wichita WaterWalk Historic Context. Wichita, Kansas.
    Prepared a historic context statement and concepts for interpretive storyboard panels to inform visitor’s about the history and development of the WaterWalk Redevelopment Area adjacent to the Wichita central business district.
